Case History
SUMMARY OF CRIM.A. NO. 1274/1999 (ASRAF v. STATE OF M.P.) The Supreme Court dismissed the appellants' appeal challenging their murder convictions. Four appellants (Asraf, Jahangir, Rashid Khan, and others) were convicted under Section 302 read with Section 34 IPC and sentenced to life imprisonment for causing fatal injuries to two victims (Hamid Khan and Babu Khan) in an incident on 11 July 1984 at Majid Khan's house in Madhya Pradesh. The court rejected the appellants' defense of private defence, finding that the incident occurred at the victim's house (not in a field as the trial court erroneously held) and that appellants were aggressors armed with weapons. The High Court's reversal of their acquittal was upheld, and appellants were directed to surrender to their bail bonds to serve the remaining portion of their sentences.
