Summary The Supreme Court of India held that a person with mental capacity has the fundamental right under Article 21 to refuse medical treatment and withdraw from life-saving devices. The Court also recognized the right of competent adults to execute advance medical directives specifying their medical treatment preferences for future incapacity. However, the Court maintained that active euthanasia through lethal drugs remains illegal; only passive euthanasia (withdrawal of life support) is permissible, and for incompetent patients, the decision must follow the "best interests principle" with appropriate safeguards and a cooling-off period. This case analysis is maintained by casestatus.in based on publicly available court records.
