1. Considering that the impugned order arises out

of the plaintiff’s/ respondents’s prayer under Order

39 Rules 1 and 2 of the Civil Procedure Code, 1908

and the matter would be considered on merits by the

Trial Court when the suit proceeds, we are not

inclined to entertain this Special Leave petition.

However, while deciding the suit, the Trial Court

shall not be influenced by the impugned order passed
