1. Leave granted.

2. The appellant challenges the judgment and order

dated 17-11-2025 in MCRC No. 50649/2025 and

02.12.2025 titled “Omkar Singh Dhurve vs. State of

Madhya Pradesh” in MCRC No. 55491/2025 passed by the

High Court of Madhya Pradesh at Gwalior.

3. The appellant was arrested on 14.08.2025 in

connection with F.I.R/Crime No.197 of 2025,

registered at Police Station-Khaniyadhana,, District-

Shivpuri, Madhya Pradesh.

4. Heard learned counsel for the parties, and perused

the material placed on record. The appellant has

filed the present appeal primarily on the basis that

High Court while granting bail, had erred in imposing

a condition of pre-deposit of amount of

Rs.31,07,661/- (Rupees Thirty One Lac Seven Thousand

Six Hundred Sixty One Only) before the Trial Court.

5. Vide order dated 08.01.2026, this Court while

issuing notice,has stayed the condition stipulated in

paragraph 7 of the impugned order dated 17.11.2025.

6. In our considered view, since the condition has

been imposed by the High Court itself and not on the

basis of the offer made by the appellant, such
