Syed Hasnal Mussanna Sha Khadri & Others (Respondents) Decision The Supreme Court partially allowed the appeals and held that: 1. Civil courts have jurisdiction to decide disputes concerning the appointment of Sajjadanashin (a spiritual office at a Dargah/shrine), despite the Dargah being a notified Waqf institution. 2. Sajjadanashin and Mutawalli are distinct offices: While a Sajjadanashin can also discharge Mutawalli functions, a Mutawalli cannot function as a Sajjadanashin. The office of Sajjadanashin is spiritual in nature and governed by custom and nomination, whereas a Mutawalli is a secular administrative position under the Waqf Board's jurisdiction. 3. The High Court erred in setting aside 37 years of litigation on jurisdiction grounds without examining the merits. The trial and appellate courts' judgments declaring the appellant as Sajjadanashin were restored. 4. The matter was remitted to the High Court to decide on merits (excluding jurisdiction) within 9 months, given the case's long pendency since 1988.
