Where an NGT order directing fresh environmental scrutiny under the Forest (Conservation) Act, 1980 results in the competent authority subsequently granting a reasoned approval after completing the mandated process, the original challenge to forest diversion orders becomes infructuous and the appeal does not survive for adjudication. Further, where a writ petition under Article 226 is pending before the High Court, a petitioner must be relegated to pursue interim and substantive reliefs before that forum, with the Supreme Court refraining from expressing any opinion on the merits.
