Mr. Ranjan Mukherjee, learned counsel appearing on behalf of the petitioner has submitted that the petitioner may be accommodated on the higher post, which is now vacant. Considering the facts and circumstances of this case, we are not inclined to issue any such direction for accommodating the petitioner on the higher post which is lying vacant. However, it is open for the petitioner to apply for the said post and compete for the selection on the said post in accordance with law. The Special Leave Petition stands disposed of accordingly.
