RESPONDENT(S) O R D E R The appellant is the divorced wife of the respondent and this appeal arises from a dispute in regard to the custody of the children. The High Court order, against which the appeal has been filed, has granted the custody of the three sons (now aged 17, 16 and 13 years respectively) to the appellant. While issuing notice by this Court, the operation of the High Court order was
stayed and as a result the children continue to remain in the custody of their mother-the appellant. In course of the protracted hearing of this case the parties have entered into a comprehensive settlement and have resolved all their pending disputes. In terms of the settlement the respondent shall pay the lump sum amount of Rs.3,00,000/- (Rupees three lakhs only) for the education and upkeep of the three children till they attain their respective ages of majority. Since the children are in the custody of the mother, the money will be paid in her hand but Mr. -2- Irsahd Ahmad, counsel appearing on her behalf, assures the Court that the money will be spent for the education and upkeep of the children. The payment of the aforesaid sum of rupees three lakhs shall be made in the following manner: 1. The respondent shall give to the appellant Jainab Khatoon @ Tahira bank draft of rupees fifty thousand drawn in her name by April 30, 2013; 2. The second installment of rupees fifty thousand also payable through bank draft and in the name of the aforesaid Jainab Khatoon @ Tahira, shall be given to her by June 30, 2013; 3. The third installment of rupees one lakh would be similarly paid by August 30, 2013, and; 4. The Final installment of the balance rupees one lakh would be similarly paid to her by October 31, 2013. The aforesaid payment of rupees three lakhs shall be in full and final settlement of all the claims of the appellant and the children. It is, however, made clear that this payment shall not deprive the children of their hereditary rights under the law by which they are governed. -3- In view of the above settlement, all proceedings instituted by one side against the other in whatever Court that may be pending, shall stand abated. The respondent who is currently working in Saudi Arabia and comes to India only on leave and in holidays would intimate the mother of the children or any one in her family about the date on which he may visit the place where the mother and children are staying, to meet his children. Mr. Irshad Ahmad assures that the mother shall not cause any obstructions in the meetings between the father and the children and would rather facilitate the meetings between the children and the father. The child appears to be quite bright. We asked him to write something and we found that his hand-writing is quite good and neat for his age and the class in which he is studying. The child explained to us in detail where the school is situate, the timings of the school, the subjects that he is taught in Class VIII, the name of his class teacher and similar other details. He appeared to be quite happy and satisfied with the way he is living at present. We do not want to disturb the present arrangement in which the children are quite happy and they are also going to schools. Learned counsel appearing for the respondent (the husband) suggested further improvement in the present arrangement. He said that at present the children's mother (the petitioner) lived in a village with her father at some distance from the place where the schools are situated. He submitted that the respondent is willing to make arrangement for the mother to live near the school with the children. The respondent is prepared to find out a suitable
accommodation at Dumaria Ganj, Siddharth Nagar, Uttar Pradesh, for the mother and the children to live together and would also deposit the money for the rental of the house. We appreciate the offer made on behalf of the respondent. However, the finding of a proper accommodation may take some time. In the meanwhile, the Court asked the learned counsel for the respondent that in order to show his bona fides and his feelings for his children, the respondent should make some monetary offer to meet the expenses of the children's education. The Court suggested that it ...3/- : 3 : would be a good gesture for the respondent to deposit a sum of `1,00,000, apart from the amount of maintenance that is to be paid under the orders of the Court, which would be spent exclusively over the children's education. The boy's mother (the petitioner in the special leave petition) is also present along with her two elder sons, who, in terms of the interim order passed by this Court, continued to remain in her custody. 2 We had a long engagement with the child-AnisurRehman, who is a young boy about 11-13 years of age, hismother and his other two brothers and his cousin AbdulWadood, with whom he has come to the Court (the paternalgrandmother is too old and she had come without herhearing-aid. It was, therefore, not possible to have any
kind of interaction with her). About three weeks ago, Anisur Rehman left hismother with whom he was living in the house of hismaternal grandparents and went to his Bua. After thematter was reported to the police he came to Okhla, NewDelhi, where he is now living with his paternalgrandmother, and his Bari Amman (wife of the elder brotherof his father) and his step-mother, the second wife of hisfather. On being asked, he said that he was unhappy withthe way he was treated by his maternal grandfather andtherefore, he had left the house. He also said that hewas very happy living with his paternal grandmother, auntand his step mother and he did not want to go back to hismother or his maternal grandparents. On being persuaded by us, however, he agreed to goback to his mother on the assurance that as soon as hisfather comes we will take up the matter of his custody andfinally decide the matter in the presence of both hisparents. We, accordingly, pass the following order :- From the Court the child Anisur Rehman shall go 3along with Abdul Wadood, who has brought him to the Court,and for the evening and the night he will stay at Okhlaalong with his paternal grandmother, his aunt and his stepmother. In the morning the aforesaid Abdul Wadood, shalltake him to his mother, who is also presently staying inDelhi and hand him over to the custody of his mother.
