1 IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION CIVIL APPEAL NO. 5257 /2022 [@ SLP [C] NO.2648/2021] THE MANAGEMENT OF ADDISON AND CO. LTD. Petitioner(s) VERSUS M. ABDUL SALAM Respondent(s) O R D E R Leave granted. We have heard learned counsel for the parties. There is no dispute that the respondent did resign though there is an issue raised whether the letter was accepted at back date and whether there was an element of duress or pressure on the respondent to resign. On these aspects, the findings of fact are against the appellant. We have perused the award of the Tribunal and the judgment of the High Court and looking to the facts and circumstances, we are inclined to modify the benefit to accrue to the respondent in terms of the impugned judgment to 50 per cent of the back wages. Twenty Five per cent of the back wages already stands paid and the remaining 25 per cent should be remitted to the respondent within a period of six weeks from today. The appeal is allowed to the aforesaid extent leaving the parties to bear their own cots.

2 The respondent may furnish the PAN Card/Aadhar Card details to the appellant as it is the submission of learned counsel for the appellant that the same would assist in the extent of deductions being less with the quantum of TDS coming down.
