UPON hearing the counsel the Court made the following O R D E R On hearing learned counsel for parties we cannot agree with the learned counsel for the petitioner that his tenure of service could not be abridged. That being

2 the position, on that short ground alone the impugned order cannot be interfered. We may however, note that there are some observations in para 22 of the impugned order with which we are not in agreement. We thus, direct that the petitioner will be able to hold the office till 31 st of this month and will be entitled to all the benefits of pay and retirement with continuity of service right till 31 st March, 2022. In the unforeseen eventuality of the respondent still not appointing a replacement, the petitioner would be entitled to work beyond 31 st March, 2022 till alternative arrangement is made. The Special Leave Petition accordingly stands disposed of. Application for intervention is dismissed. Pending applications stand disposed of. (ASHA SUNDRIYAL) (POONAM VAID) ASTT. Learned senior counsel for the petitioner contends that all employees of the Wakf Board presently employed prior to 2016 would continue to work till the age of 58 years. In a case on the post held by the petitioner, the mode of appointment is sought to be changed to one of deputation from State Government and since

2 government servants retire at the age of 56 years, that is the reason that the retirement age is sought to be reduced to 56 years for the post. He, however, submits that the same cannot affect the petitioner who was directly appointed in the year 2001 and thus would be entitled to continue till the age of 58 years. On a Court query learned counsel submits that in terms of the impugned order, leave was already granted to the petitioner to continue work till his replacement is appointed and no replacement has been appointed till date.
