Thereafter, the matter matter above mentioned was listed before the Court of Registrar on 24th August 2015, when the Court was pleased to pass the following Order: "Fresh steps for the service of notice by usual mode to the unserved respondents shall be taken by the learned counsel for the petitioner within a period of four weeks. Dasti in addition is permitted to be served on the respondent No. 1 through the Ld. Standing Counsel representing the State of Maharashtra and on the other respondent through the concerned Court the particulars of which shall be furnished by the learned counsel for the petitioner within the period prescribed above. List again on 18.11.2015." And lastly, the matter matter above mentioned was listed before the Court of Registrar on 03rd May 2016, when the Court was pleased to pass the following Order: "The Ld. Counsel for the respondent No.1 has failed to file the counter affidavit within the period stipulated under the rules. Service of notice is complete on the respondent No.2 but no one has entered appearance on his behalf. Viewed, in that context, the matter shall be processed for listing before the Hon'ble Court, under the rules." ..2/­

­2­ Accordingly, show cause notice was issued to both the respondents by registered A. D. post on 01.04.2015. Mr. Nishant R. Katneshwarkar, Advocate has entered appearance on behalf of respondent No. 1 but he has not filed counter­affidavit so far. Neither A. D. card nor unserved cover has been received back from respondent No. 2. It is further submitted that pursuant to the Ld. Registrar Court's Order dated 24.08.2015, show cause notice was sent to District Court for service upon respondent No. 2. The District Court has sent the service report in respect of respondent No. 2 stating therein that notice has been served on 01.10.2015 but no one has entered appearance on his behalf so far. Service of notice is complete. The matter above mentioned is listed before the Hon'ble Court with this report.
