Despite the above, it is submitted that the Investigating Officer is prejudicing the case of the complainant inasmuch as in his affidavit dated 23.02.2015, it has been asserted by him that Kailas Sonawane was in prisoners ward at the time of occurrence and hence there is no substance in the allegations made against him. Issue notice returnable in four weeks.” Accordingly, show cause notice was issued to all the six respondents through registered A.D. Post. It is submitted that Mr. Nishant R. Katneshwarkar, Advocate has filed vakalatnama/appearance and counter affidavit on behalf of all the six Respondents. Service of show cause notice is complete. It is further submitted that counsel for the petitioner has filed additional documents along with an application for permission to file additional documents and the same has been registered as Criminal Miscellaneous Petition No. 13386 of 2016.
