UPON hearing counsel the Court made the following O R D E R The learned Advocate-on-Record, Mr.Gp.Capt.KaranSingh Bhati, appearing on behalf of all the respondents exceptthe persons who are reported to be dead, has pointed out thatthough the appellant has failed to disclose in the Memo ofparties and failed to join all the parties of OA No.270/2010as respondent in the appeal, how and why the Registry haslisted the matter before the Hon'ble Court on 17.10.2011. Thefile be placed before the Registrar (Judl.) for enquiry thatItem No.88 -2-who has examined the appeal and why such mistake has beencarried forward till the matter was listed before the Hon'bleCourt, without verifying the Memo of parties and withoutconfirming that whether all the parties are properly disclosedin the Memo of parties or not. On specific enquiry, it hasbeen confirmed by the appellant that they are certainlychallenging the impugned order in both the OAs i.e. O.A.Nos.270 and 24/2010 and therefore, all the litigants of bothOA are certainly necessary parties before this court. All the

litigants in both the OAs are necessary parties before thiscourt. Therefore, if litigants in OA No.24/2010 are notjoined in this appeal then certainly Registry shall be carefulbefore listing the appeal before the Hon'ble Court. In viewof the above facts, if appellant fails to take appropriatesteps so far as litigants in OA No.24/2010 are concerned on orbefore 13.12.2011, the matter shall be treated accordinglyI.e. as if no appeal is preferred against the order in OANo.24/2010 and for that extent it shall be listed before theHon'ble Judge in Chambers for appropriate orders. Learned counsel for all the respondents has alsoclarified that some of the respondents are now no more and heItem No.88 -3-has given the numbers of respondent as respondent Nos.9 and 48in original OA No.270/2010 and respondent Nos.3, 24 and 71 inOA No.24/2010. In view of such disclosure, appellant has to takeappropriate steps, if they so desire. If appropriate stepsare not taken before 13.12.2011 for such respondents, list theappeal before the Hon'ble Judge in Chambers for appropriateorders for abatement or for non-prosecution against suchrespondents. Learned counsel appearing for the respondent hasalso pointed out that List of such respondents is given to thelearned counsel for the appellant alongwith DeathCertificates. Registry has also to explain in writing to theRegistrar (Judl.) that what steps have been taken by them, inview of letter dated 17.10.2011 by the learned counsel for therespondent. (S.G.
