3 “We make it very clear that this order will not preclude M/s K. Raheja from making appropriate application for regularisation of the transaction. We further make it clear that the issue whether CIDCO is entitled to regularize the transaction and whether M/s. K. Raheja are entitled to regularization are kept open and no adjudication is made on the said questions.” 4. A letter dated 04.06.2019 addressed by Government of Maharashtra to the Managing Director, CIDCO, has been brought to our notice, the relevant portion of which is reproduced hereunder :- “The decision of regularisation in respect of allotment by CIDCO to M/s K. Raheja Corporation being Plot bearing No. 39/1 and 39/6 to 39-15, area 30,621.35 Sq. Mtrs. situated at Vashi in Navi Mumbai should be taken in accordance with the regularization decision taken in respect of other plots regularised by CIDCO Board of Directors in other cases, subject to decision in the Special Leave Petition (Civil) No. 698-699/2015 filed before the Hon’ble Sdpureme Court, and subject to the approval of the Board of Directors in accordance with the prevailing procedure for regularization of the said Plot. Also the Hon’ble Supreme Court should be informed regarding the action taken in
4 this regard. ” 5. The CIDCO shall consider the application on its own merits and take an independent decision. The decision be placed on record by way of an affidavit within eight weeks from today. 6. Needless to say that the order or decision taken will be subject to the final outcome of these civil appeals. 7. List the civil appeals for hearing in the month of February, 2026.
