On perusal of the papers and upon hearing the learned counsel we find that the petitioner has not deposited a sum of Rs. 75,00,000/- as pre-deposit for hearing of an appeal, by the CESTAT (Tribunal). Therefore, the appeal filed by the petitioner has not been entertained by the Tribunal. Learned counsel submits that the petitioner is ready and willing to deposit the aforesaid amount within six weeks from today. - 2 - If the amount is so deposited, the petitioner shall file an application for revival of the appeal before the Tribunal and in that event, the Tribunal shall revive the appeal and dispose of the same on merits in accordance with law. In view of the above, the special leave petition is disposed of.
