Respondent OFFICE REPORT FOR DIRECTION IN DISPOSED OF MATTER The Transfer Petition above mentioned was listed before the Hon'ble Court on 2 nd December, 2016 when the same was disposed of in terms of signed order dated 2 nd December, 2016. Copy of the Order dated 2 nd December, 2016 is enclosed herewith for kind perusal of the Hon'ble Court. Accordingly, certified copy of the Order dated 2 nd December, 2016 was sent to the concerned Court's on 16 th December, 2016 for necessary compliance. It is submitted that the matter above-mentioned was listed before the Hon'ble Court on 5 th October, 2015 when the Court was pleased to pass the following order: “ Learned counsel appearing for the parties submits that there is a possibility of settlement between the parties in the event the matter is referred to the Supreme Court Mediation Centre. Accordingly, we refer the matter to the Supreme Court Mediation Centre. We direct the parties to appear before the Mediation Centre on 04.11.2015. The Mediator would endeavour to explore the possibility of an amicable settlement between the parties and send the Report to this Court. In the meanwhile, the respondent-husband shall deposit a sum of Rs.20,000/- (Rupees twenty thousand only) with the Registry of this Court to meet the travelling expenses of the petitioner-wife. She is given liberty to withdraw the said amount provided she puts her appearance before the Supreme Court Mediation Centre on 04.11.2015. List the matter along with Mediation Report. ” Pursuant to the order quoted above, Mr. Sanjay Jain, Advocate for the respondent has on 8 th October, 2015 deposited an amount of Rs. 20,000/- towards travelling expenses of the Petitioner. -2- It is submitted that Mr. Somanatha Padhan, Advocate for the Petitioner has on 15 th February, 2017 have filed an application for withdrawal of the amount Rs. 20,000/- deposited towards travelling expenses of the Petitioner after serving its copy on other side. It is further submitted that pursuant to the Court's order dated 12 th October, 2015 the amount is to be disbursed to Petitioner only when she puts her appearance before the Supreme Court Mediation Centre on 4 th November, 2015 but as per Mediation report dated 28 th November, 2015 she was not present on that date and a letter is also received from Petitioner dated 29 th October, 2015, stating therein that she is not willing to attend the mediation proceeding further and request to send the matter back to Hon'ble Court. It is also submitted that paper books of Transfer Petition has been weeded out after due preservation, as per practice of the Registry. Service of notice is complete. The petitioner-wife has filed an application under Section 12 of the Protection of Women from Domestic Violence Act, 2005, being Other Misc. Criminal (D.V.) Case No.227/2016, pending before the court of Chief Judicial Magistrate, Amravati and the respondent-husband has filed a petition for dissolution of marriage under Section 13(1)(ia) of the Hindu Marriage Act, 1955, being H.M.A. No.06 of 2015, pending before the court of Principal Judge, Family Courts, Dwarka, New Delhi. Learned counsel appearing for the parties have agreed that they have no objection if both the cases are transferred to the court of Principal Judge, Family Courts at Nagpur, Maharashtra.

TP(C) 523/2015 2 In view of the aforesaid, we deem it proper to allow the transfer of the aforesaid cases from the court of Chief Judicial Magistrate, Amravati and the court of Principal Judge, Family Court, Dwarka, New Delhi, to the court of Principal Judge, Family Court at Nagpur, Maharashtra, along with all records for its adjudication. The respondent-husband shall pay a sum of Rs.3,00,000/- (Rupees three lacs only) towards the litigation expenses to the petitioner-wife as she has to travel from Amravati to Nagpur. We have fixed the said amount as the Family Court Judge need not think about entertaining any application for grant of litigation expenses provided under Section 24 of the Hindu Marriage Act, 1955. However, the learned Judge may entertain the application for maintenance. We direct that the Family Court Judge shall dispose of both the cases by end of May, 2017. The Registry is directed to communicate the order passed today to the concerned courts immediately. The transfer petition is, accordingly, disposed of. ....................J. -2- It is submitted that Mediation Report dated 28 th November, 2015 has been received from the Supreme Court Mediation Centre stating therein that the respondent – husband is present alongwith his Father. The petitioner-wife is not present on 04.11.2015 and today i.e. 28.11.2015. The counsel appearing on behalf of petitioner and place a letter dated 29.10.2015 received on 5.11.2015 from the Supreme Court Registry and state that she is not willing to attend the mediation proceeding further and requested to send the matter back to the Hon'ble Court. Accordingly, the matter is referred back to the Hon'ble Court as “Non-Starter”. Copy of the mediation report dated 28 th November, 2015 has been included in the paper books. It is further submitted that Mr. Sanjay Jain, Advocate for the Respondent has on 8 th October, 2015 deposited an amount of Rs. 20,000/- towards travelling expenses of Petitioner but Mr. B.V.
