It is further submitted that pursuant to the Court's order dated 12 th October, 2015 the amount is to be disbursed to Petitioner only when she puts her appearance before the Supreme Court Mediation Centre on 4 th November, 2015 but as per Mediation report dated 28 th November, 2015 she was not present on that date and a letter is also received from Petitioner dated 29 th October, 2015, stating therein that she is not willing to attend the mediation proceeding further and request to send the matter back to Hon'ble Court. It is also submitted that paper books of Transfer Petition has been weeded out after due preservation, as per practice of the Registry. Service of notice is complete. TP(C) 523/2015 2 In view of the aforesaid, we deem it proper to allow the transfer of the aforesaid cases from the court of Chief Judicial Magistrate, Amravati and the court of Principal Judge, Family Court, Dwarka, New Delhi, to the court of Principal Judge, Family Court at Nagpur, Maharashtra, along with all records for its adjudication. The respondent-husband shall pay a sum of Rs.3,00,000/- (Rupees three lacs only) towards the litigation expenses to the petitioner-wife as she has to travel from Amravati to Nagpur. We have fixed the said amount as the Family Court Judge need not think about entertaining any application for grant of litigation expenses provided under Section 24 of the Hindu Marriage Act, 1955. The petitioner-wife is not present on 04.11.2015 and today i.e. 28.11.2015. The counsel appearing on behalf of petitioner and place a letter dated 29.10.2015 received on 5.11.2015 from the Supreme Court Registry and state that she is not willing to attend the mediation proceeding further and requested to send the matter back to the Hon'ble Court.
