No. 4/2011 This I.A has been filed in the Writ Petition filed by the petitioners herein with regard to the detention of certain goods which were meant for export. On 12th January, 2011 this Court had directed release of the goods in question, upon execution of a bond to be accompanied by a Bank Guarantee for a sum of Rs.48 lakhs. 2Pursuant thereto, the petitioners approached the CustomsAuthorities for release of the goods on the said condition.In response to the same, they were informed by the CustomsAuthorities by letter dated 21st December, 2010, that thegoods could be released on the petitioners executing on aproper stamp paper a bond for an amount ofRs.10,83,05,489/- and it was further directed that the bond

should be accompanied by a Bank Guarantee ofRs.1,20,33,943/-. This Court modified the said conditionand directed that the seized goods should be released tothe petitioners upon execution of a bond for the amount, asindicated in the said letter, to be accompanied by a BankGuarantee for a sum of Rs.48 lakhs. It appears that despite the aforesaid direction, theCustoms authorities have raised objection to the BankGuarantee which was furnished by the petitioners and adifferent format was provided to the petitioners forproviding the same. The same contains a condition wherebythe bank was required to provide the guarantee for anindefinite period. Aggrieved by the same, the petitioners have filedthe present application for a direction upon the CustomsAuthorities to receive the Bank Guarantee from thepetitioners, in the manner in which the same was furnished,with an undertaking to keep the same alive till the matteris disposed of. 3 A second prayer has been made seeking release of thegoods upon waiver of any rent, demurrage or detentioncharges having regard to Regulation 6(1)() of the Handlingof Cargo in the Customs Areas Regulation, 2009. We have heard Mr. Rohtagi, learned senior counsel insupport of the application. We have also heard the learnedSolicitor General with regard to the objections which havebeen taken on behalf of the Customs Authorities in refusingto accept the Bank Guarantee as provided by thepetitioners. The learned Solicitor General submitted thatthe Reserve Bank of India had issued guidelines with regardto the furnishing of Bank Guarantees in which it had beenmentioned that there should be an automatic clause ofrenewal of Bank Guarantee with the sole purpose of keepingthe Bank Guarantee alive during the pendency of the lis.

The learned Solicitor General submitted that the same hadbeen adopted by the Customs Authorities and, accordingly,the Bank Guarantee was required to be furnished in the saidformat. Having heard learned counsel for the parties, we areof the view that the order which we had passed earlierdirecting furnishing of Bank Guarantee, may be modified tothe extent that the Bank Guarantee is to be furnished bythe petitioners initially for a period of one year and thesame has to be kept alive till the completion of theadjudication. The bank shall issue a Bank Guarantee to 4that effect and the same is to be accepted by the CustomsAuthorities. As far as the second prayer is concerned, havingregard to Regulation 6(1)() of the Handling of Cargo inthe Customs Areas Regulation, 2009, the goods in questionshall be released in accordance with the said provision. Itwas further directed that the bond should beaccompanied by a Bank Guarantee ofRs.1,20,33,943/- equivalent to 25% of the declaredseized goods.3. I.A.3/11, which we are considering todayarises out of said letters addressed to thepetitioners.4. During the course of submission made inrespect of the said application, it has transpiredthat while the value of the goods had beendeclared at Rs.850/- per sq.ft.,the assessed valueof the custom authorities would be between Rs.40/-to Rs.80/- per square feet.5.Accordingly,for the purpose of this application,we modify the conditions mentioned in the lettersdated 21st December, 2010, and direct that theseized goods be released to the petitioners uponexecution of a bond for the amount, as indicatedin the said letters, to be accompanied by a BankGuarantee for a sum of Rs.48 Lakhs. -3-6. Admittedly, certain goods have been retained by the Customs authorities in respect of which a case had already been commenced against the petitioners. The same forms the subject matter of the Writ petition in which we had issued notice on 25th November, 2010 and had also in a subsequent order dated 29th November, 2010, requested Mr. Dey to takecontd.. - 2 -instructions with regard to the interim reliefs, prayed forin prayers (b) and (c) of the Writ Petition. Incidentally,in the companion matter, being Writ Petition (Crl.) No.123/2010, it was ordered not to arrest the petitioner duringthe pendency of the Writ petition. In continuation of the aforesaid interim order, wealso direct that the examination of the live consignmentswhich are under seizure and recording of statements of allpetitioners under Section 108 of the Customs Act, 1962,shall be taken up by the Customs Department and recording ofstatements under Section 108 would be commenced from 8thDecember, 2010 and will be completed on or before 15thDecember, 2010. Furthermore, the examination of the seizedgoods is to be concluded within two weeks, starting from 8thDecember, 2010 and ending on 22nd December, 2010. It issubmitted on behalf of the Department that the recording ofthe statements and examination of the goods under Section

108 of the above Act shall be done between 9.00 AM and 6.00PM each day and shall be completed within a week. As far asrecording of statements of the petitioners is concerned, thesame is to be conducted in the presence of the learnedadvocate, who will be allowed to stand within visibledistance but outside the bounds of hearing. The petitionersshall cooperate with the Department and once theexamination of the goods are completed, the same shallbe released to the petitioners, subject to the usualformalities. It is also directed that since the goods inquestion, are such that it may not be appropriate for thesame to be handled by labour other than those employed withthe petitioners, the petitioners will be entitled to engagetheir own labour for the purpose of packing and unpacking ofthe consignment and the same shall be allowed by theCustoms Department. The Department has also assured thatthe recording of the statement and examination of the goodswill be video-graphed.
