The counsel prays for bail citing that the petitioner (accused No. 9) has been in custody since 06.05.2022 and that he is roped in only with the aid of conspiracy theory. Moreover, there is no material to connect him with the crime barring some call detail records and the statement of CW-80. 2
3. Opposing the bail, Mr. P.V. Dinesh, learned senior counsel submits that although 167 prosecution witnesses are cited, 18 of those are the material witnesses and the trial is expected to end in June, 2024. He further submits that the State has moved application(s) for cancellation of bail of some of the co-accused and the said application(s) are pending in this Court. 4. Considering the above, the mater stands deferred to 09.07.2024. 5. The counsel will apprise the Court on the progress of the trial on the next date. 6. As the State has moved application(s) for cancellation of bail in some of the connected matters, the respective counsel for the parties pray for and are granted three weeks time, to file their respective response. The counsel would read the relevant part of the chargsheet (P 117) to point that while accused A1 to A3 were charged with direct involvement in committing the crime, the other accused Nos.5, 6, 7, 8 and 9 (petitioners) were alleged to have been involved in the conspiracy, to commit the crime. The counsel would then read the order dated 09.01.2024, whereunder the High Court granted bail to one R. Jineesh @ Kannan (accused No.7). Another bail order dated 17.01.2024 is produced which indicates that bail was also granted to A4, A5 and A6. 4. The petitioner was arrested on 06.05.2022 and by now he has been in custody for about 1 years and 7 months. 5. Mr. Goswami, would therefore argue that the four accused who were granted bail were attributed similar role of conspiracy (without direct involvement) and therefore bail should have also been favourably considered for the petitioner (A-9). by the High Court. 6.
