The petitioner (wife) contends that she is residing along with her minor child aged 8 years with her parents at Pune, Maharashtra and there would be great inconvenience for her to attend the proceedings at Patna, Bihar. Despite service of notice on the respondent, no one has put in appearance on his behalf to oppose the prayer and in our view also, it would be inconvenient to the petitioner to attend the proceedings at Patna, Bihar. Having heard learned counsel for the petitioner and having considered the facts and circumstances of the case, we deem it fit and proper to allow this transfer petition. Accordingly, Matrimonial Case No. 8 of 2023 titled as Manish Kumar v. Ankita Sinha pending before Family Court at Patna, Bihar, is ordered to be transferred to Family Court, Pune, Maharashtra. 1
Let the records of the case be transferred to the transferee Court without delay and an intimation be sent to both the Courts through e-mail for compliance.
