The petitioner has sought transfer on the ground offinancial incapacity and difficulty in travelling fromGurdaspur (Punjab) to Bandra (Mumbai) for attending theproceedings of the case filed by the respondent. Although, notice of the transfer petition has beenduly served upon the respondent, neither he nor anyadvocate has appeared on his behalf and no counteraffidavit has been filed to oppose the prayer made in thetransfer petition. In view of the above, the transfer petition isallowed and M.J.
