UPON hearing counsel the Court made the following O R D E R Taken on Board. Heard Mr. Shekhar Naphade, learned senior counsel for the petitioner and Mr. Parag P. Tripathi, learned senior counsel appearing for the respondent. -2- The only grievance of the petitioner is that the affidavit which the petitioner wanted to tender ought to have been allowed to be placed on record which the learned Single Judge had declined to do by order dated 13th March, 2013. Mr. Tripathi, learned senior counsel appearing for the respondent states that subsequent to this order the respondent had shown their inclination that affidavit be taken on record subject to the payment of appropriate cost as offered by the counsel for the petitioner. In view of the above statement, the impugned order will no longer remain. We are informed that the matter is to be listed on 8th April, 2013 before the High Court. The High Court will take the affidavit on record. Counsel for both the parties state that they will proceed on that day with the hearing of the case. The affidavit will be tendered in the Court on the
