Respondent(s) O R D E R We are satisfied that, in the present case, nothing that can even be remotely said to be criminal has been done by the appellant. The appellant was called upon, by a letter dated 18.05.2009 written by the employer of a person who had the caste certificate in his favour to verify its correctness. By letter dated 12.06.2009, the appellant, who was the then Tahsildar, Nilakottai, Dindigul District, Tamil Nadu, wrote in answer to the said letter: “I invite your attention to the reference cited. It is ascertained that the caste certificate issued to Thiru P. Ramamurthi S/o Thiru C. Perumal of old Batlagundu, H/o Batlagundu Village, Nilakkottai Taluk, Dindigul District, Tamil Nadu as Hindu Malaivedan community is genuine and was issued by then Tahsildar vide this office Letter No. 9630/86/A5 dated 27.10.86.” Having heard learned counsel appearing for both the parties, we are of the view that the reply sent by the 1
CRIMINAL APPEAL NO. 779 OF 2019 appellant was basically to the effect that his predecessor had issued the caste certificate dated 27.10.1986, which is factually correct. The addition that the certificate is ‘genuine’ must be read along with this. This being the case, this is a fit case in which FIR No. 3/18 dated 11.05.2018 is to be quashed against the appellant.
