It is further submitted that Criminal Miscellaneous Petition No. 10069 of 2013 – Application for condonation of delay in refiling Special Leave Petition arising out of same FIR was listed before Hon'ble Judge in Chambers on 12.7.2013 when His Lordship was pleased to condone the delay in refiling the Special Leave Petition. Copy of the Record of Proceedings dated 12.07.2013 is being circulated herewith for the kind perusal of the Hon'ble Court. The Criminal Miscellaneous Petition No. 10069 of 2013 has been converted as Special Leave Petition ( Criminal) No. 5900 of 2013 and is yet to be listed before the Hon'ble Court. It is submitted that there is delay of 42 days in refiling special leave petition and the same is condoned by the Competent Authority.
