Contention of the learned counsel for the petitioner is that under Rule 4(2)A of the Uttar Pradesh Government Servant (Discipline and Appeal) Rules, 1999, a Government Servant in respect of, against whom an 1

investigation, inquiry or trial relating to a criminal charge, which is connected with his position as a Government Servant or which is likely to embarrass him in the discharge of his duties or which involves moral turpitude, is pending, may, at the discretion of the appointing Authority or the Authority to whom the power of suspension has been delegated, be placed under suspension until termination of all proceedings relating to that charge. 3. It is submitted that the respondent was placed under suspension on a charge pertaining to an act which constituted an offence punishable under the Prevention of Corruption Act, 1988 and since that offence involves moral turpitude, his continuance in service would be a source of embarrassment to the establishment. 4. In such circumstances, it is submitted, the suspension ought not to have been quashed merely on ground of delay in concluding either the criminal trial or the departmental proceedings. 5.
