Case History
Case Summary: Raja v. State, Tamil Nadu The Supreme Court allowed Raja's appeal against the detention of his friend Kaliamoorthy under the Tamil Nadu Prevention of Dangerous Activities Act, 1982. The detaining authority had relied on a destruction mahzar (police document) evidencing destruction of illicit arrack seized during arrest, but crucially failed to provide a copy to the detenu despite his demand. The Court held that since this material document was relied upon by the detaining authority but withheld from the detenu, it prevented effective representation in his defence. The Court quashed the detention order on September 2, 2004. This case analysis is maintained by casestatus.in based on publicly available court records.
