Date: October 5, 2017 Summary The Supreme Court partially allowed Nabha Power Limited's appeal against PSPCL regarding interpretation of a Power Purchase Agreement (PPA) for a 1200 MW thermal power project. The court held that NPL is entitled to recover: (1) coal washing costs; (2) transportation costs from the mine site through washing to the project site, including road transportation where necessary; and (3) Calorific Value (GCV) measurements at the project site rather than mine-end.
