SUMMARY In this Hindu Endowment Act case, Ganesan challenged the Tamil Nadu Endowment Board Commissioner's order condoning a 266-day delay in filing a statutory appeal. The Supreme Court allowed Ganesan's appeal and set aside the condonation order. The Court held that while the Commissioner conducts appeals "as nearly as may be" per Civil Procedure Code procedures, the Commissioner is not a "Court" under the Hindu Religious Endowment Act, 1959.
