T.P.(C) No. 000628 - / 2025
Where a matrimonial dispute has been referred to the Supreme Court Mediation Centre and parties arrive at a voluntary settlement — including payment of permanent alimony and mutual consent for dissolution — a decree of divorce can be granted on the ground of irretrievable breakdown of marriage, with all pending inter-party litigations simultaneously quashed. As analysed on casestatus.in, courts retain full jurisdiction to accept such mediated settlements and dissolve marriages without insisting on the statutory waiting period under the Hindu Marriage Act. The voluntariness of consent, verified in vernacular where necessary, is a sine qua non for accepting such a compromise decree.
