Under Section 138 of the Negotiable Instruments Act, 1881, once issuance of a cheque is admitted or established, a statutory presumption arises in favour of the payee, which the accused must rebut; a mere discrepancy in the rate of interest charged is insufficient to displace this presumption or establish that the cheque amount was not a legally enforceable liability.
