CASE SUMMARY: M.A.C.P. No.44/2024 The Motor Accident Claims Tribunal awarded Rs.20,27,700 in compensation to six claimants (two widows, parents, and two minor children) following a fatal tractor accident on 18.9.2024 in Gadchiroli. The deceased, a 35-year-old laborer earning Rs.9,000/month, died from head injuries after the tractor owner suddenly applied brakes, causing him to fall from the mudguard and come under the vehicle's tyres. Although the tribunal found the tractor owner violated his driving license terms and insurance policy conditions, it applied the "pay and recover" principle, making both the owner and insurer jointly liable while allowing the insurer to recover payments from the owner. The compensation included loss of dependency (Rs.17,01,000), consortium damages (Rs.2,90,400), and funeral/estate losses (Rs.36,300), plus 9% interest from filing date.
