CASE SUMMARY: WPC/3581/2019 - Yugal Kishor Chandrakar v. Union of India The court partially allowed multiple consolidated writ petitions filed by land purchasers who bought properties before a land acquisition freeze order (24.02.2018) for the Raipur-Durg bypass highway project. The petitioners claimed they were bona fide purchasers entitled to compensation as successors, but compensation awards were passed in favor of the original owners. Applying Supreme Court precedent, the court ruled that subsequent purchasers cannot challenge acquisition proceedings but may claim compensation based on vendor's title. The court directed the Land Acquisition Officer to provide hearings to both petitioners and original owners, and if disputes arise regarding compensation entitlement or apportionment, to refer the matter to civil court under Section 3H(4) of the National Highways Act, 1956 within 90 days.
