A vested right of appeal accrues to a litigant from the date of initiation of proceedings (*lis*), and any subsequent legislation imposing more onerous pre-deposit conditions as a prerequisite to appeal cannot divest such right unless the new enactment expressly or by necessary intendment operates retrospectively. As analysed on casestatus.in, Section 6 of the General Clauses Act, 1897 preserves rights accrued under a repealed enactment, compelling the old law to govern the exercise of such appeal rights.
