DEEPAK MAHAWAR RESPONDENT

O R D E R

1. The petitioner-wife is seeking transfer of the divorce case instituted by the

respondent-husband bearing Case No.HMA-1665-2023 titled as “Varsha Singh vs.

Deepak Mahawar” pending before the Principal Judge, Family Court, Kota, Rajasthan

to the Court of equivalent jurisdiction at Dwarka in New Delhi.

2. Heard Ms. Akanksha Kapoor, learned counsel for the petitioner and Ms.

Radhika Gupta, learned counsel for the respondent.

3. Admittedly, the wife is residing in new Delhi, whereas, the respondent-husband

is presently living in Abu Dhabi and therefore, it is easier for him to attend the

proceedings at New Delhi rather than going to Kota, Rajasthan.

4. In view of the facts and circumstances of the case, we are satisfied that it would

be expedient for the ends of justice to transfer the subject-case as asked for by the

petitioner-wife.

5. Records shall be sent by the Court where proceedings are pending to the

transferee Court promptly and without any delay.

6. A copy of this order be sent to the concerned court for compliance.

7. The Transfer Petition stands allowed accordingly.
