The appellant has filed the instant miscellaneous application

seeking withdrawal of the suitors’ fund amount which was deposited

in C.A. No.4932 of 2023 filed by the appellant in terms of proviso

to Section 23 of the Consumer Protection (Amendment) Act, 2002.

Order 24 Rule 7 of the Supreme Court Rules, 2013 stipulates

that if the appeal is allowed by the Court, the amount deposited by

the appellant would be refunded to him without interest but if it

is dismissed, the same will be allowed to be withdrawn by the

respondent or may be disbursed as per the direction of the Court in...
