2. Despite service of notice, none has entered
appearance on behalf of the complainant-respondent
No.2.
3. The High Court of Bombay, by the impugned
judgment and order dated August 22, 2024, has
rejected the appellant’s prayer for bail.
4. The appellant, figuring as an accused in FIR
No.0322 of 2021 dated October 17, 2021 registered
with Police Station Shivaji Nagar, District Thane City,
Maharashtra, has been in custody since 18th October,
2021. It is alleged in the FIR that the appellant along
with co-accused committed offence(s) punishable
under Section(s) 307, 504, 506 read with Section 34 of
the Indian Penal Code, 1860 and Sections 37(1) and
135 of the Bombay Police Act, 1951.
5. The issue involved in this appeal is covered by
the judgment and order dated 23rd January, 2025 of
this Court in Criminal Appeal No.360/2025, titled
Barkya Kashinath Gomare v. State of Maharashtra,

whereby a co-accused of the appellant has been
granted bail.
6. Accordingly, we set aside the impugned
judgment and order.
