Leave granted.
Learned Additional Solicitor General, appearing for the
respondents, and the learned Senior Advocate, appearing for the
appellant, jointly state that the impugned judgment should be set
aside in view of the ratio laid down by this Court in Prabhat
Ranjan Singh & Anr. vs. R.K. Kushwaha & Ors.1. As per the said
decision, the roster point table, as adopted and applied in terms
of the Indian Railway Establishment Manual, would be applicable.
In view of the aforesaid statement, the impugned judgment is
set aside and it is directed that the roster point table, adopted
and applicable as per the Indian Railway Establishment Manual, will
apply. The roster point table issued by the Department of Personnel
and Training, Ministry of Personnel, Public Grievances and
Pensions, Union of India, would not be applicable in the present
situation.
