O R D E R
Heard learned counsels for the parties.
We are not inclined to interfere with the common impugned
discretionary order passed by the National Consumer Disputes
Redressal Commission (NCDRC), New Delhi and hence, the present
appeals are dismissed.
However, it will be open to the appellants to place
reliance upon the decision of this Court in “Dr. J.J. Merchant Vs.
Shrinath Chaturvedi” reported in (2002) 6 SCC 635 before the NCDRC.
It is clarified that the instant order shall not come in
the way of the NCDRC in exercising its discretion in accordance
with law and decide the matters on merits.
Pending application(s), if any, shall stand disposed of.
