DHWANI SUNIT KOTHARI @ MISS DHWANI KIRAN MEHTA v. SUNIT YOGESH KOTHARI

TP (CIVIL) NO. 495 OF 2024

1. The present transfer petition has been filed by the petitioner-wife seeking

transfer of the divorce case instituted by the respondent-husband bearing Marriage

Petition No.1529 of 2023 titled as ‘Sunit Yogesh Kothari vs. Mrs. Dhwani Sunit

Kothari @ Miss. Dhwani Kiran Mehta’ pending before the Civil Judge (Senior

Division), Pune, Maharashtra to the District & Sessions Court, South 24, Parganas,

Alipore, Kolkata, West Bengal, where she is presently residing.

2. Heard learned counsel for the parties.

3. Considering the fact that mediation between the parties has not resulted to

any settlement and domestic violence case is pending at Alipore, Kolkata, it would

be expedient in the ends of justice to transfer the subject-case as asked for by the

petitioner-wife.

4. The Court where proceedings are pending shall transfer the records to the

transferee Court promptly and without any delay.

5. The Transfer Petition stands allowed accordingly.

6. If video conferencing facility is available with the transferee Court, the

benefit of the same shall be extended to the parties.

7. A copy of this order be sent to the concerned courts for compliance.
