2. Leave granted.
3. We have heard the learned Senior counsel appearing for the
appellants and the learned Senior counsel appearing for the
respondent(s). We have also gone through the charges leveled
against respondent No.1.
4. This is a case wherein respondent No.1 was compulsorily
retired from service pursuant to the conduct of an inquiry.
This was challenged by respondent No.1 by way of a writ
petition before the High Court. The Single Judge of the High
Court partly allowed the writ petition and modified the
punishment of compulsory retirement to stoppage of increment

for 1 year with cumulative effect and directed reinstatement
with continuity of service, back wages and all attendant
benefits. This has been confirmed by the Division Bench of
the High Court vide the impugned order.
5. Though the learned Senior counsel appearing for the appellants
would press on the issue with respect to the alleged conduct
of respondent No.1 in demanding a bribe, in the absence of any
