1. Leave granted.
2. The appellant is an accused in FIR No.54/2021 dated
27.11.2021 registered with Cyber Police Station, Pune, under
Sections 406, 420 read with Section 34 of the Indian Penal
Code, 1860, Section 66-D of the Information Technology Act,
2000 and Sections 3 and 4 of the Maharashtra Protection of
Interest of Depositors (in Financial Establishments) Act,
1999.
3. The allegations are that the informant was introduced
through an investment scheme called ‘BUXCOIN’ by some of his
acquaintances. The appellant was one of the Directors of the
aforesaid company. The scheme promised a return of the
deposits at a 10% monthly rate for 20 consecutive months.
The informant is also stated to have invested an amount of
Rs. 8,69,687/- through a cryptocurrency application.
Eventually, upon being persuaded, the informant and his
associates deposited a sum of Rs. 84,34,641/-, and, as per
the impugned order of the High Court, the misappropriated
funds exceeded Rs. 99,75,361/-.
4. It seems that the appellant was initially absconding. He
was eventually arrested on 06.01.2024 and has been in
custody since then. It is not in dispute that investigation...
