O R D E R

The present contempt petitions are filed by the petitioner

alleging wilful disobedience of the decision of this Court dated

10.12.2021 in Civil Appeal Nos.5074-5075/2019 by which this Court

affirmed the order passed by the Appellate Tribunal holding that

the respondents therein are not liable to pay the additional

surcharge. It is the case on behalf of the applicant(s) that

despite the levy of additional surcharge has been set aside by this

Court, the respondent/Distribution Company has issued the

bill/demand for the month of November, 2021, demanding additional

surcharge which has been set aside by this Court. One another

grievance which is voiced is that despite the specific

observation/direction by this Court in para 16 of the judgment and

order dated 10.12.2021 that the additional surcharge already

recovered from the captive consumers/captive users shall be

adjusted in the future wheeling charges bills, the same has not

been implemented and the same has not been given credit and/or

adjusted in the future bills.
