Leave granted.
The learned counsel appearing for the first respondent-State
pointed that though the appellant has attended for investigation,
he is not extending “desired cooperation”.
After having heard the learned counsel appearing for the
appellant, the learned counsel appearing for the first respondent-
State and the learned senior counsel appearing of the second
respondent-first informant, we find that the case is mainly based
on the documentary evidence.
At this stage, we find that the custodial interrogation of the
appellant may not be required. Hence, the interim order dated
17th January, 2024, is made absolute on the same terms and
conditions.
The Appeals are allowed.
