1 Delay condoned.

2 Leave granted.

3 On 1 April 2022, the following order was passed by this Court:

“1 The petitioner who stands convicted for an offence punishable under Section 302 read with Section 34 of the Indian Penal Code 1860 and Section 25 of the Arms Act 1959 is stated to have undergone imprisonment for a term over 14 years 4 months without remission and 17 years 7 months with remission.

2 Issue notice on the application for condonation of delay and on the Special Leave Petition.

3 Liberty to serve the Standing Counsel for the State of Uttar Pradesh, in addition.

4 List the Special Leave Petition on 22 April 2022.”

4 The Office Report indicates that the State of Uttar Pradesh has been served.

5 As the above order indicates, the appellant has undergone actual sentence

of over 14 years without remission. Since the appeal before the High Court of

Judicature at Allahabad is unlikely to be heard at an early date, we order and

direct that the appellant shall be released on bail subject to such terms and

conditions as may be imposed by the Sessions Court in connection with

Sessions Trial Nos 429 and 430 of 1999.
