IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION
CIVIL APPEAL NO.12480 OF 2024
KUMUD PANDEYA ... APPELLANT(S)
VS.
UNION OF INDIA & ORS. ... RESPONDENT(S)
O R D E R
Heard the learned senior counsel appearing for the
appellant.
We have perused the opinions of the Medical Board
dated 6th April, 2002, the Review Medical Board and then
the Release Medical Board. The last was the Release
Medical Board in the year 2015 wherein the blood pressure
readings recorded of the appellant were 130/90 mmHg. On
the basis of one reading, one cannot jump to the
conclusion that the appellant was suffering from
Hypertension. The disability mentioned in Release
Medical Board report of 2015 is obesity. Therefore, his
disability was assessed at less than 20 per cent. The
contention that due to service conditions, the appellant
suffered from Hypertension cannot be accepted. On the
basis of evidence on record, we find no error in the view
taken by the Tribunal.

The appeal is accordingly dismissed.
