O R D E R
1. Leave granted.
2. The High Court of Judicature at Patna by the impugned judgment
and order dated 15th October, 2025 has rejected the appellant’s prayer
for bail.
3. The appellant, figuring as an accused in FIR No. 258 of 2025
dated 2nd July, 2025 registered with Police Station Code 33/59, is in
custody since 3rd July, 2025. It is alleged in the FIR that the appellant
committed offence(s) punishable under Section 30(a) of the Bihar
Prohibition & Excise Act, as amended.
4. We have heard learned counsel appearing for the parties and
perused the materials on record.
5. The police report (charge-sheet) has been filed and the case has

been listed on 23rd December, 2025 for framing of charges. That apart,
the appellant has no criminal antecedents.
6. Accordingly, we set aside the impugned judgment and order.
7. Appellant shall be released on bail, subject to furnishing of bail
bonds to the satisfaction of the trial court and such other terms and
conditions as may be imposed by it.
