1. The appellant challenges the judgment and order dated

08.10.2025 in Criminal Appeal No.683/2024 passed by the

High Court of Judicature at Allahabad, titled “Sudhir &

Ors. vs. State of U.P. & Anr.”.

2. It is not in dispute that the private parties herein

hail from the very same community, notified under the

provisions of the Scheduled Castes and the Scheduled

Tribes (Prevention of Atrocities) Act, 1989 (for short,

the Act, 1989).

3. In view of the above, the order dated 04.11.2023

passed in UPMP010101342023 by the learned Special Judge,

SC/ST (Prevention of Atrocities) Act, to the extent of

summoning the appellant herein, with respect to the

offences punishable under Section 3(2)(v) of the Act,

1989, stands quashed.

4. Insofar as other offences under the provisions of the

Indian Penal Code, 1860 are concerned, the Trial Court

shall proceed with the same.

5. The trial is expedited.

6. Accordingly, the present appeal stands partly

allowed.

7. Pending application(s), if any, shall stand disposed

of.
