1. The petitioners have filed the petition under Section

406 of the Bharatiya Nagarik Suraksha Sanhita, 2023 before

this Court seeking transfer of Case bearing Complaint No.

165 of 2020 titled as “Archana Sharma & Ors. Vs. Deepchand

& Ors.” pending in the Court of Judicial Magistrate, First

Class, Gorakhpur to the Court of Additional Chief Judicial

Magistrate, Bhiwadi, District Khairthal-Tijara, Rajasthan.

2. Having heard learned counsel appearing for the parties

and taking into consideration the grounds taken in the

transfer petition, we are not inclined to transfer the

case sought for. The Transfer Petition is, accordingly,

dismissed.

3. However, if the video conferencing facility is

available with the Court, the benefit of the same shall be

extended to the parties.

4. Pending application(s), if any, shall stand disposed

of.
