O R D E R
1. Leave granted.
2. The appellant apprehends his arrest in
connection with FIR No.257/2022 dated 07.04.2022
registered at Police Station – Civil Lines,
District – Moradabad, Uttar Pradesh for the
offences punishable under Sections 147, 307,
120B of the Indian Penal Code, 1860.
3. Admittedly, the chargesheet in the present case
has been filed on 01.10.2024. The learned
counsel appearing for the respondent no. 1
-State submits that the appellant has not been
appearing before the concerned Trial Court. Per
contra, the learned counsel appearing for the

appellant would submit that the appellant has
appeared on two occasions before the Trial Court
but his presence was not accepted by the Trial
Court. Learned counsel for the appellant thus
submits that the appellant was indeed present
before the Trial Court.
4. We have heard the learned counsel appearing for
the appellant and the learned counsel appearing
for the respondents.
5. The fact remains that the chargesheet in the
present case has been filed already and,
therefore, custodial interrogation of the
appellant is certainly not required at ...
