O R D E R
1. Leave granted.
2. The High Court of Judicature for Rajasthan,
Jaipur Bench, Jaipur, by the impugned judgment
and order dated 31st July, 2025, has dismissed
the appellant’s second application for bail.
3. The appellant, figuring as an accused in FIR
No.0216 of 2023 dated 28th May, 2023 registered
at Police Station Suroth, District Karauli under
Sections 147, 148, 149 & 302 of the Indian Penal
Code, 1860 and Sections 3, 4 & 25 of the Arms
CRIMINAL APPEAL No. 5558/2025 1
Act, 1959 (Amendment 2019), was arrested on
16th June, 2023.
4. We have heard learned counsel appearing
for the parties and perused the materials on
record.
5. Trial is in progress. Evidence of 13 witnesses
out of 46 witnesses proposed to be examined by
the prosecution to drive home the charges has
been recorded so far.
6. Claims and counter-claims are raised by the
parties. Lest any observation made by us affects
the trial, we propose not to express any opinion
on the merits of the rival claims.
7. However, taking an overall view of the
matter, we are of the considered opinion that
further detention of the appellant pending trial is
not necessary and that while the appeal
deserves acceptance, the appellant may be
admitted...
