2. Leave granted.
3. The High Court of Madhya Pradesh by the impugned order dated 5th April,
2024 has directed the appellants to appoint the respondents as Auxiliary Nurse
cum Midwife1, subject to outcome of the writ petitions filed by the respondents.

4. It is not in dispute that in terms of the amended rules governing
recruitment on the post of ANM, the respondents are not eligible and the
subject matter of challenge before the High Court relates to the constitutionality
of such amended rules.
5. Such being the position, we are of the considered view that the High Court
ought not to have made any interim order directing appointment of the
respondents. The amended rules have not been stayed. The High Court has also
